Prince of Wales Appeal Agreement

As previously advised, the Association made the decision to engage in a mediation process with MRCC Ltd, proponents of the Prince of Wales development. Following negotiations, both parties recently signed a deed of agreement, and the Association subsequently withdrew its appeal against the development.

Key elements of the agreement are:

1. Noise and Visual Impact

  • Ensuring that air-conditioning units are hidden or screened from public view.
  • Relocating the mechanical plant to the interior of the structure to minimise noise and visual impact.

2. Protection of Neighbouring Properties

  • Rectify any damage to nominated nearby buildings, including the community hall, caused during the building process.

3. Landscaping and Vegetation

  • Retain existing trees and vegetation on Hampden Road (apart from the tree beside Da Angelo) and Kelly Street and all vegetation at 43 South Street.
  • Additionally, plant trees including along the boundary with 41 South Street.
  • Ensure that all new plantings are established stock, non-deciduous and provide effective screening, privacy and noise attenuation.

4. Heritage and Design

  • Use materials and finishes, including brickwork and window finishes, that are consistent with the heritage character of Battery Point.
  • The developers to consult with BPCA regarding external colours, materials and finishes – this process in underway.

This agreement is the result of a time-consuming and complex process. The Association is confident that it has achieved good outcomes for the community. We are grateful to the developers for engaging constructively in the mediation process.
